Venues  (County/Judicial Circuit)

The "venue" is the part of the Notarial Certificate that says in which state and county the notarial act took place and is required for every notarial certificate.  It usually appears at the top of the document being notarized and/or at the beginning of the Notarial Certificate.  In some instances where there is limited space, the venue information may appear near the bottom of the certificate.  

       The Hawaii counties are:

County of Hawaii (Third)
City & County of Honolulu (First)
County of Kauai (Fifth)
County of Maui (Second)

Hawaii Notarial Certificates

Attorney-in-Fact:  The person(s) given certain powers under a Power of Attorney document.  When signing by authority of a Power of Attorney, the Attorney-in-Fact is the one that appears before the Notary.  

The Hawaii Notary Public Manual stipulates that Notaries should never perform individual attorney-in-fact notarizations unless they are completely satisfied that the attorney-in-fact does indeed have the authority to represent the absent signer and that the Power of Attorney has not expired.  

The best proof is the ORIGINAL Power ofAttorney document, which gives the requisite information from which the Notary may determine if the Attorney-in-Fact has been given the authority to sign the particular document.  Copies are not good proof as it may not be possible to detect alterations.

A Notary who is not completely satisifed that the Attorney-in-Fact does have the authority to represent the absent signer SHOULD NOT complete the notarization.

Jurat
 
An Attorney-in-Fact CANNOT sign a document for another that requires notarization in the form of a Jurat, because the Jurat requires that the signer swear or affirm, under oath, to the truth of the information in the document and is a matter of conscience.
